Terms of Service
Welcome to the YHA Do it 4 Real Camp Blog ('The Blog'). Before you begin using The Blog, you must read and agree to these Terms of Service ("Terms of Service") and the following terms and conditions and policies, including any future amendments (collectively, the "Agreement"). Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version (http://www.doit4real.co.uk/home.htm and click on Privacy/Terms of Service Policy at the bottom of the page) YHA England & Wales Ltd may, in its sole discretion, modify or revise these Terms of Service and policies at any time and you agree to be bound by such modifications or revisions. If you do not accept and abide by this Agreement, you may not use the Do it 4 Real Blog. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
- Description of Service. YHA Do it 4 Real Blog is an online community for people who are or who hope to attend YHA Do it 4 Real Summer Camps. Use of this community is restricted to topics relating to Summer Camps i.e. First Time at Camp and Making Friends.
- Blog/Message Board Content: We welcome you to post your messages, ideas and views to the Blog, subject to your agreement to comply with these Terms of Use. Please be aware that in order to operate the Blog or redistribute materials that you post to the Blog or otherwise submit to us, we acquire certain rights in those materials. Therefore, by posting to the Blog or otherwise transmitting comments, ideas or other information (collectively "Submissions") to us, you are granting us and our designees a worldwide, non-exclusive, assignable, royalty-free, perpetual, and irrevocable right and license to copy, distribute, transmit, reproduce, edit, translate and reformat, create derivative works based on, publicly perform, publicly display, and/or incorporate into a collective work, such Submissions (in whole or in part) in any media now known or hereafter developed in connection with the operation of the Blog, without compensation to you or any other provider of the Submissions. You also permit any other User to access, display, view, store and reproduce such Submissions for personal use.
- Personal Identification. Please be aware that if you decide to disclose personally identifiable information on the Blog, this information may become public. YHA England & Wales Ltd does not control the acts of other users of the Blog, so please be cautious when deciding to reveal personal information on the Blog. If you believe a User is improperly collecting or using information about you or other users, please contact (doit4real@yha.org.uk ). You acknowledge that to the extent that you include personally identifiable information in Submissions, we may republish such information as part of the content. If we publicly display, publicly perform, reproduce, republish or distribute copies of your Submissions, or incorporate your Submissions into a collective work, we will make best efforts to credit your authorship by listing your name as well. You grant YHA England & Wales Ltd the right to use your name for such attribution purposes. In addition, you agree to represent yourself accurately, and acknowledge that misrepresentation may lead YHA England & Wales Ltd, in our sole discretion, to cancel your use of the Blog services and delete any of your Submissions.
- Blog Community Rules. We have adopted the "Blog Community Rules" set forth below to create a forum where information and views can be shared. While using the Blog, you agree to adhere to the Blog Community Rules below:
You agree to:
- Respect - and be polite to - other Bloggers - please do not threaten, insult, abuse, intimidate or harass other Blog users;
- Submit only your own work or work that you have the right to submit.
You agree NOT to:
- Post any private information or otherwise harvest, collect or disclose information, about another Blogger without his or her express consent;
- Post any content to the Blog that is unlawful, hateful, libellous, intimidating, threatening, defamatory, abusive, obscene, or that discriminates against or harasses particular individuals or groups;
- Post any photographic or video material to the blog;
- Post any content to the Blog that infringes any third-party's intellectual property or other rights;
- Use the Blog for any unlawful purpose, or transmit or otherwise make available in connection with the Blog any material that would give rise to criminal or civil liability;
- Use the Blog for advertisements, chain letters, "spamming," survey solicitations, junk mail or solicitations, or to sell or market your products to other Bloggers;
- Impersonate any person or entity, including YHA England & Wales Ltd and YHA England & Wales Ltd employees, or falsely state or otherwise misrepresent your affiliation with any person or entity;
- Imply that YHA England & Wales Ltd endorses any of your statements or positions;
- Transmit any harmful, invasive or disruptive code or other materials (such as viruses, worms, web bugs, or other harmful components) through or to the Blog, or otherwise "hack" or deface any portion of the Blog;
- Frame or mirror any part of the Blog without our prior written authorisation.
- You acknowledge that YHA England & Wales Ltd has the right, but not the obligation, to modify or remove, any Submissions that violate the Blog Community Rules or that otherwise violate these Terms of Use.
- Proper Use. You agree that you are responsible for your own use of the Service, for any posts you make and for any consequences thereof. You will be responsible for all activities occurring under your username and for keeping your password secure. You agree that you will use the Service in compliance with all applicable national and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all UK export control laws.
- Service Provision. You understand and agree that the Service is provided to you on an AS IS and AS AVAILABLE basis. YHA England & Wales Ltd disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. YHA England & Wales also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.
- Age Restrictions. You must be at least eleven (11) years of age to use the Service. YHA England & Wales reserves the right to refuse service to anyone at any time without notice for any reason. Membership of the Service is void where prohibited. This Site is intended solely for users who are (11) years of age or older. Any registration by, use of or access to the Site by anyone under (11) is unauthorised, unlicensed and in violation of these Terms of Use. By using the Service or the Site, you represent and warrant that you are (11) or older and in high school or college, or else that you are 18 or older, and that you agree to and to abide by all of the terms and conditions of this Agreement.
- Content Policy. You agree to abide by the YHA England & Wales Content Policy (and the rules and restrictions therein. Although we may attempt to notify you when major changes are made to the YHA England & Wales Content Policy, you should periodically review the most up-to-date version. YHA Do it 4 Real may, in its sole discretion, modify or revise the Content Policy at any time and you agree to be bound by such modifications or revisions. Violation of any of the foregoing, including the YHA England & Wales Ltd Content Policy (http://www.doit4real.co.uk/home.htm# and click on Content Policy at the bottom of the page), may result in immediate termination of this Agreement and may subject you to legal consequences. YHA England & Wales reserves the right, but shall have no obligation, to investigate your use of the Service in order to (a) determine whether a violation of the Agreement has occurred or (b) comply with any applicable law, regulation, legal process or governmental request.
- Administration & Monitoring. Much of the content of the YHA Do it 4 Real Blog, including the contents of specific postings, is provided by and is the responsibility of the person or people who made such postings. YHA England & Wales Ltd closely monitors the content of the YHA Do it 4 Real Blog but does not take responsibility for such content.
- Privacy. As a condition of using the Service, you agree to the terms of the YHA England & Wales Privacy Policy ((http://www.doit4real.co.uk/home.htm# and click on Privacy/Content Policy at the bottom of the page), which may be updated from time to time, as expressed in the most recent version that exists at the time of your use. You agree that YHA England & Wales Ltd may access or disclose your personal information, including the content of your communications, if YHA England & Wales Ltd is required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute or court order) or as otherwise provided in these Terms of Service and the general YHA England & Wales Ltd Privacy Policy.
- General Practices Regarding Use and Storage. You agree that YHA England & Wales Ltd has no responsibility or liability for the deletion of or the failure to store or to transmit, any Content and other communications maintained by the Service. YHA England & Wales Ltd retains the right to create limits on use and storage at our sole discretion at any time with or without notice.
- Third Party Content. YHA England & Wales Ltd takes no responsibility for third-party content (including, without limitation, any viruses or other disabling features), nor does YHA England & Wales Ltd have any obligation to monitor such third-party content. YHA England & Wales Ltd reserves the right at all times to remove or refuse to distribute any content on the Service, such as content which violates the terms of this Agreement. YHA England & Wales Ltd also reserves the right to access, read, preserve and disclose any information as it reasonably believes is necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this Agreement, including investigation of potential violations hereof, (c) detect, prevent or otherwise address fraud, security or technical issues, (d) reply to user support requests or (e) protect the rights, property or safety of YHA England & Wales Ltd, its users and the public. YHA England & Wales Ltd will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.
- Intellectual Property Rights. You acknowledge that YHA England & Wales Ltd owns all right, title and interest in and to the Service, including all intellectual property rights (the " YHA England & Wales Ltd Rights"). YHA England & Wales Ltd Rights are protected by U.K and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify or create derivative works from the Service. You also agree that you will not use any robot, spider, other automated device or manual process to monitor or copy any content from the Service. As described below, YHA England & Wales Ltd Rights do not include third-party content used as part of the Service, including the content of communications appearing on the Service.
- Your Intellectual Property Rights. YHA England & Wales Ltd claims no ownership or control over any Content submitted, posted or displayed by you on or through YHA England & Wales Ltd. You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any Content you submit, post or display on or through YHA England & Wales Ltd services and you are responsible for protecting those rights, as appropriate. YHA England & Wales Ltd furthermore reserves the right to refuse to accept, post, display or transmit any Content in its sole discretion. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content submitted.
- Representations and Warranties. You represent and warrant that (a) all of the information provided by you to YHA England & Wales Ltd to participate in the Service is correct and current; and (b) that you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.
- Termination; Suspension. YHA England & Wales Ltd may, in its sole discretion, at any time and for any reason, terminate the Service, terminate this Agreement or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system for some time for back-up purposes. Sections 2, 3, 5 - 8 and 10 - 15 of the Agreement, along with applicable provisions of the general Terms of Service shall survive expiry or termination.
- Indemnification. You agree to hold harmless and indemnify YHA England & Wales Ltd and its subsidiaries, affiliates, officers, agents and employees from and against any third-party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgements, litigation costs and attorneys' fees, of every kind and nature. In such a case, YHA England & Wales Ltd will provide you with written notice of such claim, suit or action.
- Entire Agreement. This Agreement constitutes of the entire agreement between you and YHA England & Wales Ltd and governs your use of the Service, superseding any prior agreements between you and YHA England & Wales Ltd. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other YHA England & Wales Ltd products and/or services, affiliate services or third-party content.
- Waiver and Severability of Terms. The failure of YHA England & Wales Ltd to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.
